Conduct: David Mayor failed to ensure that Taxi Van & Truck Ltd (Taxi) complied with its statutory obligations to submit quarterly VAT returns to HMRC for 16 consecutive VAT quarters from at least 7 April 2012 when the VAT return for the quarter ending 28 February 2012 fell due to be submitted, HMRC have submitted a claim in the liquidation for £733,253 of which £552,778 relates to VAT assessments and £126,582 to interest penalties and surcharges, in that:-

  • Taxi failed to submit any quarterly VAT returns to HMRC for 16 consecutive VAT quarters from the VAT quarter ended 28 February 2012 to the VAT quarter ended 30 November 2016.
  • In the absence of VAT returns for the quarters ended 28 February 2012 through to 30 November 2016, HMRC raised VAT assessments totalling £629,792 of which 3 were from officer assessments. Between 2014 and June 2016 payments of £50,000 (of which £5,206 was paid to surcharges) were made resulting in an underpayment of assessed VAT in the sum of £552,778.
  • HMRC have been making enquires into Taxi’s VAT affairs since at least December 2012.
  • On 20 May 2015 a “legal request” to produce documents to enable HMRC to check the VAT position was made. These records were not delivered up to HMRC, neither were VAT returns submitted.
  • At liquidation, other creditors totalled £3,000 and HMRC totalled £733,253.
