Conduct: Dean Mitchell (“Mr Mitchell”) caused Paveway Blockpaving and Landscapes Limited (“Paveway”) to sell Plant Machinery belonging to the Bank without the prior permission of the Bank, in that: Paveway was incorporated on 10 September 2019 with Mr Mitchell as the sole director and shareholder. On 14 March 2022 Paveway obtained via a hire purchase agreement a JCB through the Bank, whose contract, signed by Mr Mitchell stated, “you will not sell the equipment to anyone without the prior permission” of the Bank. On 02 April 2022 Paveway obtained via a hire purchase agreement an OUTLANDER, whose contract, signed by Mr Mitchell stated, “you will not sell the equipment to anyone without the prior permission” of the Bank. On 07 April 2022 Paveway obtained via a hire purchase agreement a BOBCAT, whose contract, signed by Mr Mitchell stated, “you will not sell the equipment to anyone without the prior permission” of the Bank. Between August 2022 and September 2022 Mr Mitchell sold the JCB, OUTLANDER and BOBCAT for £33,000, all without the prior permission of the Bank. Mr Mitchell states that the proceeds of the sales were received in cash and retained by him, and that they were used for business expenses and wages. Mr Mitchell has provided no records to evidence this. On 19 December 2022 Paveway was Wound Up in the High Court of Justice Business and Property Court in Birmingham. The company has total liabilities of £178,078, of which £42,435.77 relates to the amount owed in respect of the Plant Machinery.
