Conduct: Forkan Mahmud (“Mr Mahmud”) breached his duties as the director of Sunflower Foods Limited (“SF”) by failing to ensure that it complied with legislative requirements in that: • SF did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 by employing three people who did not have the right to work • Home Office Immigration Enforcement (“HOIE”) after investigating Company issued a Notification of Liability for a Civil Penalty of £30,000 in respect of the employment of three workers, payment of which was due on or before 02 May 2024. • SF has not paid the paid the penalty due to HOIE. • Mr Mahmud was an appointed director of SF at the time of the breach of the Immigration, Asylum and Nationality legislation.
