Conduct: Umer Nisar (“Mr Nisar”) caused or allowed Wandser Inc Limited (“WIL”) to breach the terms of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 when it wasn’t entitled to receive a BBL and/or by overstating its turnover/estimated turnover when applying for the BBL, when he either knew or should have known that the company wasn’t entitled to a BBL of that amount: • Under the BBL scheme businesses that were carrying on business on 1 March 2020 and engaged in trading or commercial activity in the UK at the date of the application could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. • WIL was incorporated on 4 February 2020 and its business bank account was not in operation until 6 April 2020. The company was not trading as at 1 March 2020 and it was therefore not entitled to make a BBL application. • At the time of applying for its bank account on 26 February 2020 WIP estimated its turnover to be £1,500. • The BBL application form stated, “If your business was established after 1 January 2019, you should apply the 25% limit to your estimated annual turnover from the date you started your business.” • A BBL application for £50,000 signed by Mr Nisar was made on 15 May 2020 stating an estimated annual turnover of £250,000. • In fact WIL’s income was £6,411 prior to the BBL application being made, which pro-rata would result in an annual turnover of £76,934. WIL would therefore have been entitled to a BBL of only £19,234. • On 30 June 2022 the BBL account was closed with a final balance of £34,778 outstanding
