Conduct: On or around 09 November 2020, Mrs Rachal Gardner (“Mrs Gardner”) caused James Store Ltd (“JSL”) to breach the terms of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 when she knew, or ought to have known, that the company was not entitled to a BBL. Furthermore, Mrs Gardner failed to ensure the funds were used for the economic benefit of JSL, in that: • Under the BBL scheme, businesses could apply for a BBL of between £2,000 and £50,000 subject to a maximum of up to 25% of their 2019 turnover, if it was carrying on business on 01 March 2020, engaged in trading or commercial activity in the UK at the date of the application, and had been adversely affected by the Covid pandemic. • JSL was incorporated at Companies House on 03 September 2019. • JSL filed dormant accounts for the period 03 September 2019 to 30 September 2020. • On or around 09 November 2020, Mrs Gardner applied for a BBL of £50,000 on behalf of JSL, declaring a company turnover of £200,000. • On 09 November 2020, the £50,000 BBL funds were paid into JSL’s bank account. • Prior to the receipt of the BBL funds, there had been no other activity in JSL’s bank account. • Therefore, JSL was not carrying on business on 01 March 2020, and was therefore not eligible for any BBL funds. • The BBL was to be used only for the economic benefit of the business and not for personal purposes. • Between 09 November 2020 and 21 June 2021, £27,000 of the BBL funds was transferred to an associate of Mrs Gardner. • Between 20 November 2020 and 23 June 2021, £13,000 of the BBL funds was transferred to Mrs Gardner. • On 17 February 2021, £10,000 of the BBL funds was transferred to Mrs Gardner’s associated company. • No evidence has been provided to demonstrate the BBL funds were used for the economic benefit of JSL. • JSL was wound up on 28 August 2024 with liabilities of £54,627, of which £50,987 related to the BBL.
