Conduct: Mrs Ayesha Maduwanthi Ganewatta Kankanamge (“Mrs Kankanamge”) breached her duties as a director of Gemini Restaurant Ltd (“Gemini”) by failing to ensure that it complied with legislative requirements in that: • Gemini did not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006, resulting in the employment of a person who did not have the right to work in the United Kingdom. • On 24 January 2025 Home Office Immigration Enforcement (“HOIE”) identified that a worker employed by Gemini had no right to work in the UK. • On 11 March 2025 the Home Office issued a Notification of Liability for Civil Penalty of £45,000 in respect of the employment of the worker, payment of which was due on or before 11 April 2025. • Gemini has repaid £2,500.02 of the penalty and the balance which remains outstanding is £42,499.98. • Mrs Kankanamge has not provided any evidence to show that the Company conducted “right to work checks” in respect of the worker.
