Conduct: Mr Mehmet Kutlubay (“Mr M Kutlubay”) breached his duties as a director of BM Bar and Grill Limited, trading as Meze Grill, (“BM”) by failing to ensure that it complied with legislative requirements in that: • BM did not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006, resulting in the employment of five people who did not have the right to work in the United Kingdom. • On 17 October 2024, following a visit at BM’s trading premises the Home Office Immigration Enforcement (“HOIE”) identified that five workers present had no right to work in the UK. • On 07 January 2025, the Home Office issued a Notification of Liability for a Civil Penalty of £200,000 in respect of the employment of the five workers, payment of which was due on or before 06 February 2025. • BM did not pay the penalty of £200,000 due to HOIE which remained outstanding in full at liquidation on 19 August 2025. • Mr M Kutlubay was appointed as the director of BM on 20 February 2024 and was present at BM’s trading premises on the day of HOIE visit. Mr M Kutlubay remained a director until liquidation. • At Liquidation on 19 August 2025, BM had liabilities of £316,334, of which £200,000 relates to the outstanding Civil Penalty.
