Conduct: Mr Nyef Kalaf ("Mr Kalaf") breached his legal duties as the director of Sponj Bob Car Wash Ltd ("Sponj Bob") by failing to ensure that it complied with legislative requirements. In that: • Sponj Bob did not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006 resulting in the employment of one individual who did not have the right to work. • The Home Office Immigration Enforcement ("HOIE") visited Sponj Bob's trading premises on 28 June 2024 where an individual who was not eligible to work in the UK was identified. As a result, HOIE issued a Notification of Liability for a Civil Penalty of £45,000 in respect of the employment of one worker, payment of which was due on or before 11 September 2024. • Mr Kalaf has failed to provide sufficient records to evidence that Sponj Bob carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of one person who did not have the right to work or the right to work for the tasks they were performing. • Mr Kalaf was the sole director of Sponj Bob at the time of the breaches of the 2006 Act. • Sponj Bob has not paid the penalty due to HOIE and has therefore not complied with its requirements under the 2006 Act. • At Liquidation on 06 December 2024, Sponj Bob had liabilities of £45,000, all of which relates to the outstanding civil penalty.
