Conduct: Fatmir Pacoli (“Mr Pacoli”) breached his duties as the director of Foxton Car Wash Ltd (“FCWL”) by failing to ensure that FCWL complied with legislative requirements. In that: • FCWL did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006, resulting in the employment of two illegal workers; • Following an investigation, Home Office Immigration Enforcement (“HOIE”) issued FCWL with a Notification of Liability for a Civil Penalty of £80,000 in respect of the employment of two illegal workers, payment of which was due on or before 13 June 2024; • On 24 June 2024 HOIE issued an Objection Outcome Notice to FCWL. This notice stated that FCWL remained liable for the penalty of £80,000 and payment was due on or before 22 July 2024; • FCWL failed to make any payment against the Civil Penalty of £80,000 which remains outstanding in full and entered Creditors Voluntary Liquidation on 08 August 2024; • Mr Pacoli was the sole appointed director of FCWL from 20 April 2022 until the date of liquidation.
