Conduct: Between 22 January 2021 and 09 December 2022, John Voss (“Mr Voss”) acted as a director of City of Cars Ltd (“City”) while he was prohibited from doing so by way of a Bankruptcy Restrictions Undertaking (“BRU”), in that: •Mr Voss had a bankruptcy order made against him on 03 October 2018. •On 16 May 2019, Mr Voss signed a BRU which was in effect until 15 May 2023. •City was incorporated on 22 January 2021 and traded until it entered Creditor’s Voluntary Liquidation on 09 December 2022. •Mr Voss acted as a director of City throughout its trading. Whilst acting as a director, Mr Voss caused or allowed City to misuse finance facilities between 12 August 2022 and 09 November 2022, resulting in a loss to the lenders of at least £277,195, in that: • City traded as a car dealership which included arranging finance for vehicles between the customer and lenders. • Between 12 August 2022 and 09 November 2022, City received finance from lenders for at least 18 vehicles which were not provided to customers. • The total sum received for these 18 vehicles is £277,195.20 • The lenders for all 18 vehicles have stated that the money was paid to City, however none of the customers received the vehicle which the finance was for. • City subsequently failed to return the funds to the lender, despite the vehicles not being delivered to the customers. • At Liquidation, City had creditors totalling £317,850.68. Of this total, at least £277,195.20 relates to the misuse of the financing facilities available.

Of this total, at least £277,195.20 relates to the misuse of the financing facilities available.
