Conduct: Tatyana Rurenko caused AKI Group Ltd (“AKI”) to trade to the detriment of H M Revenue & Customs (“HMRC”) in respect of VAT from 01 May 2021, and in respect of PAYE/NIC for the tax years 2021/22, 2022/23 and 2023/24. In that:- VAT • AKI failed to make any payments to HMRC in respect of its VAT liabilities for the quarters 04/22 to the cessation of trading. • AKI failed to submit VAT returns for the quarters ended 01/23 to the cessation of trading causing HMRC to raise assessments for those periods. • HMRC raised assessments totalling £32,715 for the quarters ending 01/23 to the cessation of trading, surcharges totalling £1,105, and penalties totalling £592. • Liabilities totalling £54,657 in respect of VAT (inclusive of surcharges and penalties) are due to HMRC in the Liquidation. PAYE/NIC • Liabilities totalling £94,588 are due in respect of PAYE/NIC for the tax years 2021/2022 to 2023/2024 to HMRC. • Payments in respect of PAYE fell behind in April 2021 • HMRC agreed a repayment arrangement with AKI on 25 November 2021 for repayment of its PAYE/NIC liabilities but AKI failed to keep to the terms of the payment arrangement. • HMRC agreed a further repayment arrangement with AKI on 08 April 2022 for repayment of its PAYE/NIC liabilities but AKI failed to keep to the terms of the payment arrangement. • AKI failed to make any payments to HMRC after 26 July 2022 in respect of its PAYE/NIC liabilities. • Liabilities totalling £94,588 in respect of PAYE/NIC (inclusive of interest) are due to HMRC in the Liquidation. COMPARATIVE TREATMENT • A review of AKI’s bank account between 01 May 2021 to liquidation shows £1,592,256 paid in and £1,597,371 paid out. • Of the £1,597,371 paid out £611,637 was paid to trade creditors, and £622,756 was paid as wages, and £221,369 was paid for other expenses. • During the same period £28,241 was paid to HMRC in respect of taxes. At liquidation creditors totalled £180,825 of which £134,726 was owed to HMRC in respect of all taxes.
