Conduct: Willian Gomes Nunes (“Mr Nunes”) breached his duties as a director of Capowillians Ltd (“Capowillians”) by failing to ensure that it complied with legislative requirements in that: • Capowillians did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006, resulting in the employment of 12 workers who did not have the right to work in the United Kingdom. • Home Office Immigration Enforcement (“HOIE”), after investigating the company, issued a Notification of Liability for a Civil Penalty Notice of £105,000 in respect of the employment of 7 of these workers who did not have the right to work in the UK, payment of which was due on or before 24 November 2023. • HOIE after attending Capowillians work premises again on 02 February 2023 and investigating the company, issued a further Notification of Liability for a Civil Penalty Notice of £75,000 in respect of the employment of 5 further workers who did not have the right to work in the UK, payment of which was due on or before 12 December 2023. • Capowillians has not paid either of the fines due to HOIE. • Mr Nunes was an appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation.
