Conduct: Gary Lee Stewart (“Mr Stewart”) caused Yorsec Ltd (“Yorsec”) to submit incorrect VAT returns to HMRC, resulting in the company claiming VAT of £303,790 to which it was not entitled, in that • Mr Stewart was a director of Yorsec from 06 October 2020 until liquidation. • A bank account was opened with Bank A on or around 01 December 2021. • Dormant accounts were filed for the years ending 31 October 2021 and 31 October 2022. • Despite dormant accounts being filed Yorsec applied for VAT registration with effect from 1 February 2022 and VAT returns were submitted to HMRC during 2022. • Between the quarters ending 07/22 and 04/24, VAT returns were submitted to HMRC for the repayment of the sum of £303,790, which was paid into the Yorsec’s bank account. During the same period Yorsec’s income totalled £22,868. • Between August 2022 and February 2024, a total of £298,237.97 of the £303,790 received from the HMRC VAT repayments was transferred from Yorsec’s bank account to Mr Stewart’s personal account despite him having no entitlement to the funds • On 28 May 2024 Mr Stewart advised HMRC that VAT returns for the periods 07/22 to 04/22 had been incorrectly completed resulting in the company having been repaid at least £270,145 more than it was due. • HMRC have submitted a claim in liquidation in the sum of £278,771 in respect of VAT for the period 01 February 2022 to liquidation.
