Conduct: Between 1 June 2021 and 30 November 2021, Mr David King (“Mr King”) failed to ensure House Hold Appliances 247 Limited (“HHA247”) complied with Regulation 21(1)(b) & 21(A)1 of The Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”) in that: • On 21 May 2021 HHA247 obtained caller data from a third-party supplier while not registered as a data controller with the Information Commissioner’s Office (“ICO”), in breach of its obligations under the Data Protection Act 2018 and UK GDPR. • HHA247 failed to screen the data against the Telephone Preference Service (“TPS”) register, as required under Regulation 21(1)(b) of the Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”). • HHA247 was later investigated by the ICO following two complaints submitted via the TPS and the ICO Online Reporting Tool (“OLRT”). The complaints related to repeated unsolicited calls, which led to a vulnerable individual registered with the TPS entering into multiple agreements for the same product. • Between 1 June 2021 and 30 November 2021, the ICO found that HHA247 made 19,069 unsolicited direct marketing calls using a public telecommunications service to TPS-registered individuals, in breach of Regulation 21(1)(b) of PECR. • Calls made by HHA247 were made using withheld caller IDs, breaching Regulation 21A(1) of PECR, which mandates caller identification. • On 22 June 2023, the ICO issued HHA247 with a Notice of Intent (“NOI”) for multiple breaches of Regulation 21 of PECR. The proposed penalty was £55,000. • On 3 August 2023, The ICO issued a Monetary Penalty Notice (“MPN”) for the amount of £55,000 as HHA247 had failed to make representations by the appeal deadline; the penalty remained unpaid at the time of liquidation.
