Conduct: Hasna Jahan (“Mrs Jahan”) breached her duties as a director of Banwell Chillies Ltd trading as Chillies Bangladeshi and Indian Restaurant (“BCL”) by failing to ensure that it complied with its legislative requirements, in that: • BCL did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) by employing 4 people who did not have the right to work. • Home Office Immigration Enforcement (“HOIE”) Officers carried out a visit to the trading premises of BCL on 30 September 2022, and, as a result, issued a Notification of Liability for Civil Penalties on 16 February 2023 amounting to £40,000 in respect of the employment of 4 workers. • Subsequent to the receipt of an objection form from BCL, an Objection Outcome Notice was issued on 27 March 2023, upholding the above £40,000 penalty in full. It was to be paid by 26 April 2023. • BCL did not make any payments to HOIE in respect of the outstanding penalties. • Mrs Jahann was the sole director of the company at the time of these breaches of the Immigration, Asylum and Nationality legislation
