Conduct: Sulekha Haque (“Mrs Haque”) breached her duties as a director of Cinnamon Spice Glastonbury Ltd (“Cinnamon Spice”) by failing to ensure that it complied with legislative requirements, in that: • Cinnamon Spice did not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006, resulting in the employment of two people who did not have the right to work in the United Kingdom. • On 23 March 2024, following a visit at Cinnamon Spice’s trading premises the Home Office Immigration Enforcement (“HOIE”) identified that two workers present had no right to work in the UK. • On 23 April 2024, the Home Office issued a Notification of Liability for a Civil Penalty of £80,000 in respect of the employment of the two workers, payment of which was due on or before 23 May 2024. • On 03 June 2024, after consideration of an objection submitted by Mrs Haque, the Civil Penalty of £80,000 was upheld and was required to be paid on or before 03 July 2024. • Cinnamon Spice did not pay the penalty of £80,000 due to HOIE which remained outstanding in full at liquidation on 14 November 2024. • Mrs Haque was appointed as a director from 20 August 2020 until liquidation. • At Liquidation on 14 November 2024, Cinnamon Spice had liabilities of £144,400, of which £80,000 relates to the outstanding Civil Penalty.
