Conduct: Between 1 February 2021 to at least 31 July 2021 Belal Ali failed to ensure that Apex Assure Ltd (“Apex”) complied with regulation 21 and 24 of the Privacy and Electronic Communications (EC Directive) Regulations 2003 in that: • Between 1 February 2021 to 31 July 2021, Apex made a total of 2,112,155 telephone calls. Of these telephone calls, 1,096,622 calls were made to telephone numbers that had opted out of receiving such calls by being registered with the Telephone Preference Service (“TPS”) for more than 28 days, which was in breach of Regulation 21 of PECR. • Apex made 1,096,922 unsolicited direct marketing calls to subscribers registered with the TPS, resulting in 122 complaints made to the TPS and Information Commissioners Office (“ICO”). • The ICO report states that there is no evidence that any steps were taken to comply with PECR • On 17 May 2021 the ICO commenced an investigation into suspected contraventions of PECR regulations by Apex. • On 21 July 2022 the ICO served Apex a notice of intent (“NOI”) to issue a monetary penalty. • On 17 October 2022, the ICO issued a monetary fine of £230,000 against Apex for the contravention of regulation 21 and 24 of the PECR to be paid by 17 November 2022, which remained outstanding in full at liquidation.
