Conduct: On 24 July 2020 Mr Jalal Hasan Ali (“Mr Ali“) caused FFC Fried Chicken Ltd (“the company”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known that the company was not eligible for the loan scheme. In that: Under the BBL scheme, businesses were able to apply for a BBL if they were carrying on business on 1 March 2020, engaged in trading activity in the UK at the date of the BBL application and had been adversely impacted by Coronavirus. On 24 July 2020 Mr Ali applied for a BBL of £50,000 on behalf of the company stating on the application form that the 2019 turnover was £285,870. Mr Ali declared on the application that: “I/We confirm that my/our business was carrying on its business on 1st March 2020, that I was/we were engaged in trading or commercial activity in the United Kingdom as at the date of this application…” The company received the BBL funds of £50,000 on 28 July 2020. The company operated one known bank account which was opened on 28 July 2020 with no transactions prior to receipt of the BBL monies. Companies House records show that the company was incorporated on 19 June 2020 and as such was not eligible to apply for a BBL of any amount. Total liabilities at liquidation amount to £51,000 of which £50,000 relates to the amount owed in respect of the BBL.
