Conduct: Ferki Hashani (“Mr Hashani”) breached his duties as the director of Camden Car Wash Ltd (“Camden”) by failing to ensure that it complied with legislative requirements, in that: • Camden did not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006 (“the 2006 Act“) resulting in the employment of three people who did not have the right to work in the United Kingdom. • On 20 August 2024, following a visit at Camden’s trading premises, the Home Office Immigration Enforcement (“HOIE”) identified that three workers present had no right to work in the United Kingdom. • On 30 October 2024, the Home Office issued a Notification of Liability for a Civil Penalty of £120,000 in respect of the employment of the three workers, payment of which was due on or before 29 November 2024. • On 11 November 2024, after consideration of an objection submitted by Mr Hashani, the Civil Penalty of £120,000 was upheld and was required to be paid on or before 11 December 2024. • Camden has not paid the penalty due to HOIE and has therefore not complied with its requirements under the 2006 Act. • Mr Hashani was the sole-appointed director of Camden at the time of the breach of the 2006 Act. • At Liquidation on 27 November 2024, Camden had liabilities of £134,439, of which £120,000 relates to the outstanding Civil Penalty.
