Conduct: During May 2020 Miss Davina Steele (“Miss Steele”) caused South Tees Leisure Limited (“the Company”) to apply for a Bounce Back Loan (“BBL”) in the sum of £50,000.00 when she knew, or ought to have known, that the company was not entitled to in that: • Under the BBL scheme businesses which were established on or before 1st March 2020 and were carrying on business on 01 March 2020 and were engaged in trading or commercial activity at the date of the application could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. • The company was incorporated on 2nd March 2020. • On 19th May 2020 Miss Steele applied for a BBL in the sum of £50,000.00 on behalf of the company declaring that its turnover was £900,000.00. • The company received the BBL funds in the sum of £50,000.00 on 27th May 2020. • The company operated one known bank account, of which Miss Steele was a joint signatory , opened on 11th May 2020 with one transaction prior to receipt of the BBL funds. • Total liabilities at liquidation as per the statement of affairs totalled £51,000.00 of which £50,000.00 relates to the amount owed in respect of the BBL. Miss Steele failed to ensure that the company maintained and/or preserved adequate accounting records, or alternatively, she has failed to deliver up to the joint Liquidators of the Company, for a period from 27th May 2020, the date of the first cash withdrawal from the company account to 14th January 2021, the date of the last withdrawal, such records as were maintained, with the consequence that: • It has not been possible to determine whether ATM and cash withdrawals from the company bank account totalling £50,085 from 27th May 2020 to 14th January 2021 represent legitimate company expenditure and use of the BBL funds.
