Conduct: On 26 August 2020, Shueb Khan (“Mr Khan”) caused Cooks Cottage LTD (“Cooks”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known, that the turnover figure used in the application was overstated, which resulted in Cooks obtaining a BBL that was greater than it was entitled to. Additionally, Mr Khan failed to ensure that the BBL funds of £50,000 were used for the economic benefit of Cooks, in breach of the BBL terms and conditions; in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure was that for the calendar year 2019 or, where a business was established after 1 January 2019, it is their estimated annual turnover. • Cooks was incorporated on 24 January 2020 and began trading in January 2020. • On 26 August 2020, Mr Khan applied for a BBL of £50,000 on behalf of Cooks stating an estimated turnover of £220,000. • Bank statements show the first transaction in Cooks’ account occurred on 26 February 2020. • Cooks’ accounts show turnover of £67,042 for the period ended 31 January 2021. • Between 26 February 2020 and 27 August 2020, bank statements show total income, excluding the BBL receipt, of £24,007. • Cooks received BBL funds of £50,000 on 27 August 2020. • On 28 August 2020 the BBL funds of £50,000 were transferred from the company’s account to Mr Khan’s personal bank account. • Mr. Khan has not provided evidence as to how the sum of £50,000 was used for the economic benefit of Cooks. • Cooks entered liquidation on 30 June 2025. • At liquidation, Cooks had total liabilities of £60,380, of which £43,441 related to the outstanding BBL.
