Conduct: MR TAHIRI On or around 06 December 2020, Mr Armelind Tahiri ("Mr Tahiri") caused Italvenice Limited (“Italvenice”) to apply for a Government backed Bounce Back Loan ("BBL") in the sum of £50,000 to which Italvenice was not eligible. Thereafter the BBL was paid into Italvenice's Bank account on 07 December and was not used in its entirety for the economic benefit of the business. In that: BBL Misapplication • On or around 06 December 2020, Italvenice applied for a BBL in the sum of £50,000. Mr Tahiri submitted the application on behalf of Italvenice. • The BBL funds in the sum of £50,000 were received into Italvenice's bank account on 07 December 2020. • As part of the BBL application, the applicant was required to declare that Italvenice was carrying on its business as at 01 March 2020. • No evidence has been provided to show that Italvenice was trading on or before 1 March 2020. • Italvenice's bankers have confirmed that its bank account was opened on 03 November 2020 and the initial transaction on the account was on 20 November 2020. • The Statement of Affairs sworn on 21 April 2023 records an outstanding amount owed to the Bank in the sum of £50,000. • The Bank subsequently submitted a Proof of Debt in Italvenice's liquidation confirming that the sum of £49,483.67 remained outstanding in respect of the BBL which included interest of £317. Use of BBL funds • A condition of the BBL scheme was that BBL funds were required to be used for the economic benefit of the business and not for personal benefit. • The BBL in the sum of £50,000 was received into Italvenice's bank account on 07 December 2020 increasing the balance on the account to £51,380.20. • On 08 December 2020, the sum of £25,000 was transferred to Mr Tahiri, and £25,000 was transferred to the codirector of Italvenice. • No evidence has been provided to show that the payment of £25,000 to Mr Tahiri was for the economic benefit of Italvenice.
