Conduct: On 04 February 2021 Soraya Khoobyari (“Ms Khoobyari”) applied for a £50,000 Bounce Back Loan (“BBL”) for Capriccio Pizza Limited (“CP”) by providing misleading information about its relevant turnover. CP was only entitled to a maximum BBL of £15,158 in that: • Under the BBL scheme a business that was established before 01 January 2019 could apply for a loan of 25% of its turnover in the 2019 calendar year, up to a maximum of £50,000 or if established after 01 January 2019 an estimated turnover could be used; • CP was incorporated on 23 January 2020 and commenced trading around 19 February 2020. As such CP was entitled to provide a reasonable estimate of Company annual turnover from the date it started business; • On 04 February 2021 Ms Khoobyari applied for a £50,000 BBL and declared a turnover of £265,000 based on estimated turnover; • Analysis of CP’s bank statements show that in the period from commencement of trading to the date of the BBL application (19 February 2020 to 04 February 2021) the Company received income from trading totalling £58,306.89. • A Company Tax Return completed by Ms Khoobyari on 10 March 2021 for the period 23 January 2020 to 22 January 2021 states turnover of £57,584. • Turnover of £57,584 for the period 19 February 2020 to 04 February 2021 equates to annual turnover of £60,633. On the basis of which CP’s BBL eligibility, the BBL would only have been £15,158; • The BBL remains outstanding. Lloyds Bank is a creditor in CP’s liquidation in respect of £45,574.43.
