Conduct: On 05 May 2020 Omer Cagatay Kulekci (“Mr Kulekci”) caused Noktada Limited (“Noktada”) to apply for a Government backed Bounce Back Loan (BBL) of £30,000 and on 07 May 2020 applied for a BBL top-up of £20,000. Mr Kulecki caused Noktada to expend at least £24,000 of the BBL funds that did not provide economic benefit to Noktada, in breach of the terms and conditions in that: • On 05 May 2020, Mr Kulekci applied for a BBL on behalf of Noktada of £30,000, declaring that” I/We undertake to use the credit granted on the basis of this agreement only to provide economic benefit to my/our business, for example, providing working capital, or investing in my/our business. I/We also confirm that the Bounce Back Loan will be used wholly for business purposes and not personal purposes”. • On 07 May 2020, Noktada received a BBL of £30,000. The balance on the Company's bank account prior to receipt of the BBL was £1,340. • On 11 May 2020, £25,340 was transferred to Mr Kulekci’s personal account, contrary to the requirement that BBL funds be used for the benefit of the business. • Mr Kulekci has failed to provide evidence that this payment was for the benefit of Naktada • Total liabilities at Liquidation amount to £135,862, of which at least £48,618 relates to the amount owed in respect of the BBL.
