Conduct: On 01 April 2021, Nicholas Smith (“Mr Smith”) ”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Bespoke Scaffolding South Wales Limited (“Bespoke”) to make a BBL application of £50,000 when he knew or ought to have known that Bespoke was not eligible for the loan under the terms of the BBL scheme, in that: • The BBL eligibility criteria was that a business had to be carrying on business on 1 March 2020, engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by coronavirus (COVID-19). The information provided was self-certified by the applicant. The loan was to be used to provide economic benefit to the company, wholly for business purposes and not personal purposes. • Bespoke was incorporated on 10 December 2019 and was therefore able to estimate its turnover when applying for a BBL providing the company was carrying on business as of 01 March 2020. • Bespoke’s fixed asset schedule shows the first transaction on 10 May 2020 and the accountant’s engagement terms were signed on 02 October 2020. • Between Bespoke’s bank account opening on 11 October 2020 and 05 April 2021, analysis of the Bespoke’s bank statements show credits totalling of £39,367. The balance on the bank account prior to receipt of the BBL funds was £9,314. • On 01 April 2021, Mr Smith applied for a BBL on behalf of Bespoke. Mr Smith declared that Bespoke was carrying on business as of 01 March 2020 and had a turnover of £200,000. • Bespoke’s filed accounts for the periods ending 31 March 2021 shows turnover of £50,982. • On 06 April 2021, Bespoke received a BBL of £50,000. Bespoke was not eligible for a BBL of any amount given it was not carrying on business on 01 March 2020. • Total liabilities at Liquidation on 22 February 2024, amount to £47,838 of which at least £46,925 relates to the amount owed in respect of the BBL.
