Conduct: Spencer Cuckney (‘Mr Cuckney’) caused Nxtgen Health Coach Ltd (‘Nxtgen’) to act in breach of the rules of the Government-backed bounce back loan (‘BBL’) scheme by obtaining a BBL in the sum of £50,000 by providing false or knowingly inaccurate information concerning Nxtgen’s turnover, in that: - The terms of the BBL scheme were such that an applicant company could obtain a BBL of up to 25% of its turnover for the 2019 calendar year if it had been trading before 01 January 2019 or of its estimated annual turnover from the date it started, if trading began after 01 January 2019, up to a maximum value of £50,000. - Nxtgen Health Coach Ltd was incorporated and commenced trading on 19 December 2019. - On or around 24 August 2020 Mr Cuckney applied for a BBL of £50,000 from Nxtgen’s bank stating that Nxtgen’s estimated annual turnover was £200,000. - The BBL application was approved and the BBL monies were deposited into Nxtgen’s bank account on 26 August 2020. - Nxtgen’s bank account was opened in January 2020. According to bank statements, Nxtgen had a turnover of Nil in the first 9 months of trading. - There is no evidence to support the estimated turnover figure of £200,000 that Mr Cuckney put on the BBL application form. - Nxtgen entered into creditors’ voluntary liquidation on 09 March 2023. - No repayments were made in respect of the BBL and £50,7334 remained outstanding at liquidation.
