Conduct: On 16 May 2020, Adele Betul Guner (“Miss Guner”) caused Elystashere ABG Ltd (“EABG”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000 when she knew, or ought to have known, that EABG did not meet the criteria for the loan and was not eligible for a BBL of any amount. Miss Guner has also failed to evidence that transactions totalling £36,726, from the BBL funds, were for the economic benefit of EABG, in breach of the BBL terms and conditions. In that: • To be eligible to apply for the BBL, a borrower had to declare that the company was carrying on its business on 01 March 2020. • The company was incorporated on 28 November 2019 whereupon Miss Guner was appointed as sole director, and remained so, until Liquidation. • On 16 May 2020, Miss Guner applied for a BBL of £50,000 on behalf of EABG. • On 18 May 2020, funds of £50,000 were credited to EABG’s bank account. • EABG filed dormant accounts for Year ending 30 November 2020. • Miss Guner has failed to provide any evidence that EAGB was carrying on business as at 01 March 2020. • It was a condition of the BBL Scheme that all funds were to be used for the economic benefit of the applicant business. • Miss Guner has provided no evidence that transactions totalling £36,726 and derived from BBL funds, were in the economic benefit of EABG. • Total liabilities at liquidation amount to £40,881, all of which was in respect of the BBL.
