Conduct: Miss Jahana Begum (‘Miss Begum’) caused LUXE LASH CO LONDON LIMITED (‘LLCL’) to breach the terms and conditions of the Government backed Bounce Back Loan (‘BBL’) scheme by applying for a government backed BBL of £50,000, when she knew, or ought to have known, that LLCL was not eligible for any BBL, furthermore Miss Begum failed to ensure that the entirety of the BBL funds were used for the economic benefit of LLCL, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year. Businesses could receive a BBL of between £2,000 and £50,000. If a company was established after 01 January 2019, it was allowed to estimate turnover from the date the company started to trade. • A business was only eligible for a BBL if it was carrying on business on 1 March 2020, engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by coronavirus (COVID-19). The information provided was self-certified by the applicant. • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business it was being claimed for, used wholly for business purposes and not personal purposes. • LLCL was incorporated at Companies House on 26 November 2019 but never traded. Miss Begum stated that the business never came operational. For this reason, LLCL was ineligible to apply for a BBL of any amount as it was not carrying on business on the 01 March 2020 and was furthermore not engaged in trading or commercial activity at the time of the BBL application on 03 August 2020. • On 03 August 2020, Miss Begum applied for a £50,000 BBL for LLCL and gave an estimated turnover of £250,000. • On 04 August 2020, the company’s account received the £50,000 BBL funds. The account was opened on the same day and the BBL is the first transaction. • On 19 August 2020 the sum of £35,000 was transferred from the company account to Miss Begum. £30,000 was used for a deposit for a purchase of a flat in London for personal use. • The £30,000 was not for the economic benefit of LLCL and was contrary to the BBL scheme terms and conditions. At liquidation, on the petition of Barclays Bank, LLCL had total liabilities of at least £49,997.56 which was wholly comprised of the £49,997.56 owed to Barclays Bank in respect of the BBL
