Conduct: On 06 May 2020 Mr Darren Webster ("Mr Webster") caused D M Travel Limited ("DMT") to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by overestimating its turnover on the BBL application, resulting in DMT receiving more funds than it was entitled to from the scheme. Additionally, BBL funds received totalling £42,800 were not used for the economic benefit of DMT. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or if the business was established after 01 January 2019, it was the estimated annual turnover from the date it commenced trading. • DMT was incorporated on 08 November 2019 and could therefore use its estimated annual turnover. • On 06 May 2020 Mr Webster completed a BBL application form on behalf of DMT stating that its estimated turnover was £200,000, and requesting a BBL in the amount of £30,000. On 11 May 2020 DMT received the BBL funds of £30,000 into its bank account. On 04 December 2020 DMT received a further £20,000 in BBL top up funds. • Bank statements relating to DMT’s sole bank account, show an income of £7,210.83 in the period 28 November 2019 (when the bank account opened) to 06 May 2020 (when the BBL was applied for). From 07 May 2020 to 06 May 2021 one amount of £258.04 was received into DMT’s bank account. • Mr Webster stated that the declared turnover figure in the BBL application was based on projections for DMT. Information provided by Mr Webster shows that the projected turnover was £94,880. Based on this turnover, DMT would have been entitled to a maximum BBL of £23,720. • By making an application to borrow at total of £50,000 DMT received BBL funds of at least £26,280 more than it was entitled to. • The BBL Scheme required the applicant to declare that the BBL funds would be used for the economic benefit of the business, and not be used for personal benefit. • Following receipt of the BBL and top up in the sum of £50,000, £42,800 was paid to Mr Webster in the period 11 May 2020 to 22 June 2021, which was not for the economic benefit of DMT. • Payments totalling £3,744 were made in relation to the BBL leaving an amount outstanding at the date of the Liquidation of £47,349, out of total liabilities in the amount of £55,749.
