Conduct: On 09 March 2021, Stephen Borg (“Mr Borg”) caused Rugooo Ltd (“the Company”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by obtaining a BBL of £45,000 which Mr Borg knew, or ought to have known, that the Company was not eligible for a loan of any amount and that the declarations he had made on the BBL application were false. In that: • Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover for the 12 months from the date the business started. To be eligible for the scheme, a business had to have been carrying on its business on 01 March 2020 and been adversely impacted by Covid-19.     • The Company was incorporated on 04 November 2019, in correspondence with the Insolvency Service Mr Borg stated that it commenced trading on 07 December 2020. • Analysis of its bank statements shows that between 10 December 2019 and 01 April 2020, there were no transactions made on the Company bank account. • Micro company accounts made up to 31 March 2021 do not show turnover and the balance on the Balance Sheet is £1. • On 09 March 2021, Mr Borg applied for a £45,000 BBL on behalf of the Company, declaring the Company was carrying on its business on 01 March 2020, had been adversely impacted by Covid-19 and had an annual turnover of £180,000. BBL funds of £45,000 were credited into the Company’s bank account on 16 March 2021. • There is no evidence that the company was eligible for a BBL as it was not carrying on its business on 01 March 2020, and was not therefore adversely impacted by Covid-19. • At Liquidation £42,818 was owed in respect of the BBL, out of total liabilities of £44,784
