Conduct: In September 2020, Dale Thomas Howe (“Mr Howe ”) caused Dales Logistics Ltd (“Dales”) to apply for and receive a Bounce Back Loan (“BBL”) in the sum of £50,000, when he knew or ought to have known that this was in breach of the terms and conditions of the BBL facility as Dales had already received a £20,000 BBL from another financial institution. In addition, the full amount of the loan was paid to Mr Howe and not used for the economic benefit of Dales In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. The BBL scheme eligibility criteria allowed for businesses to only receive BBL funds of £50,00 maximum, with the applicant declaring that the company was not in the process of applying for or had already received a BBL. • Dales operated two bank accounts, one with Bank A and one with Bank B. • On 18 May 2020, Dales received a £20,000 BBL from Bank A. • On 11 September 2020, Dales received a £50,000 BBL from Bank B. • The maximum amount that a business could borrow under the BBL scheme was £50,000. • Following receipt of the £50,000 BBL from Bank B, on 14 September 2020 £50,000 was paid to Mr Howe. There is no evidence that these funds were used for the economic benefit of Dales • At liquidation on the 30 April 2024, there was £48,919 outstanding to Bank B in respect of the BBL.
