Conduct: On 21 May 2020 Josephine Wanjiru Njogu (“Ms Njogu”) caused Jo&George Auctioneers Limited (“Jo&George”) to make an application for and obtain a Government backed Bounce Back Loan (“BBL”) of £50,000 for which Jo&George was not eligible for. In that: • The Bounce Back Loan (“BBL”) scheme allowed businesses to apply for a BBL if they were carrying on business on 01 March 2020, engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by Covid. A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019. • Jo&George was incorporated on 28 October 2019. • On 21 May 2020 Ms Njogu applied for a BBL of £50,000 and stated the annual turnover for Jo&George was £200,000 and confirmed that Jo&George was carrying on business on 01 March 2020. • The company bank account was opened on 05 March 2020 and first transaction was on 26 May 2020. • On 26 May 2020, a BBL of £50,000 was paid into Jo&George’s bank account. • The company was not trading on 1 March 2020 and not entitled to the BBL. • Between 26 May 2020 and 29 June 2020 £32,000 was paid to Ms Njogu and between 06 July 2020 to 07 October 2020 a further £17,100 was paid to Ms Njogu. • On 02 November 2022, Jo&George entered compulsory liquidation with known liabilities of £49,620, owed in respect of the BBL.
