Conduct: Mr Viorel-Marius Petrache (“Mr Petrache”) breached his duties as a director of Ozcem Limited (“Ozcem”) trading as Turkish Kitchen by failing to ensure that it complied with legislative requirements, in that: • Ozcem did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of 2 people who did not have the right to work or the right to work for the tasks they were performing. • Home Office Immigration Enforcement (“HOIE”) visited Ozcem’s trading premises on 16 April 2024 and, after investigating the company, issued a Notice of Liability for Civil Penalty of £80,000 on 13 May 2024, in respect of the employment of two workers, which was due for payment on or before 12 June 2024. • After consideration of an objection submitted by Mr Petrache on 31 May 2024, the Civil Penalty was upheld, payment of which was due on or before 04 July 2024. • Ozcem has not paid the penalty due to HOIE and has therefore not complied with its requirements under the 2006 Act. At Liquidation on 24 September 2024, Ozcem had liabilities of £90,219, of which £80,000 relates to the outstanding civil penalty. • Mr Petrache was the appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation.
