Conduct: On or around 06 February 2021, Lauren Horne (“Ms Horne”) provided information that she knew or ought to have known was incorrect information concerning the turnover of Dottie’s Drinks Ltd (“Dottie’s”) resulting in Dottie’s obtaining a BBL of £50,000 which was £43,889 more than entitled. In that: • Dottie’s was incorporated on 17 October 2019. Ms Horne was Dottie’s sole director from the date of appointment until its entry into creditors voluntary liquidation. • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • On or around 6 February 2021 Ms Horne applied for a BBL. • Dottie’s opened its first bank account on 22 May 2020. Ms Horne has provided documents indicating that before this account was opened, purchases were made on Dottie’s behalf through her personal bank statement from February 2020 at the latest. Dottie’s ought therefore to have provided an estimate of annual turnover on the BBL application form. • According to Dottie’s general ledger, sales in the period between 22 July 2020 and the date of the BBL application came to £14,259. That sum was generated in a period of 7 months. An estimate of turnover over a twelve-month period of £24,444 would have entitled Dottie’s to a BBL of a maximum of £6,111. • Ms Horne declared Dottie’s estimated annual turnover as being £250,000. The value of the loan she applied for and which Dottie’s received was £50,000. • Accordingly, Dottie’s obtained a BBL of some £43,889 in excess of the value to which it was entitled to apply under the rules of the BBL scheme. • In liquidation the amount owed to creditors totals £86,324, of which £48,293 is a debt owed in respect of the BBL.
