Conduct: On 18 November 2020, Sean Martin Anderson (“Mr Anderson”) caused Newgen Fashion Limited (“Newgen”) to apply for a Bounce Back Loan (“BBL”) when it was not eligible to do so, which caused Newgen to obtain BBL funds of £45,000 to which it was not entitled. In that: • To qualify for a BBL loan, Newgen must have been carrying on its business on 1 March 2020, been engaged in trading or commercial activity in the UK at the date of the application and been adversely affected by Covid 19. • Newgen was incorporated on 16 October 2019 and Mr Anderson stated that Newgen commenced trading in October 2019 but has provided no evidence to support this. • Newgen’s business bank account was opened in May 2020 and the first activity on the account was on 18 November 2020 when the BBL funds of £45,000 were received. • On 18 November 2020, Mr Anderson applied for a BBL of £45,000 on behalf of Newgen declaring that its turnover was £180,000. • No evidence has been provided to show that Newgen was carrying on business on 1 March 2020 or engaged in trading or commercial activity at the date of the BBL application. • Mr Anderson caused £39,577 of the BBL funds to be utilised for his personal benefit or to be paid to a connected company. • Total liabilities at liquidation amount to £48,896 of which £45,296 relates to the amount owed in respect of the BBL.
