Conduct: Mr Ciprian Constantin Prodan (‘Mr Prodan’) caused Sash-Design Limited (‘Sash’) to act in breach of the rules of the Government-backed bounce back loan (‘BBL’) scheme by obtaining a BBL in the sum of £50,000 for which the company was not eligible by providing false or knowingly inaccurate information concerning Sash’s eligibility and turnover, in that: - The terms of the BBL scheme were such that an applicant company could obtain a BBL of up to 25% of its turnover for the 2019 calendar year if it had been trading before 01 January 2019 or of its estimated annual turnover from the date it started trading, if trading began after 01 January 2019, up to a maximum value of £50,000. The applicant was required to have been carrying on business as at 01 March 2020 and to have suffered adverse impact as a result of the Covid-19 pandemic. - Sash was incorporated on 16 October 2019 and therefore entitled to use estimated turnover when making a BBL application. - Sash’s bank account was opened on or around 06 July 2020 according to Sash’s bank statements. - On 24 July 2020 Mr Prodan applied for a BBL of £50,000 from Sash’s bank stating that Sash’s estimated annual turnover was £300,000. - The application form contained declarations that Sash was carrying on its business as at 01 March 2020 and had been adversely impacted by Covid-19. - The BBL application was approved and the BBL monies were deposited into Sash’s bank account on 24 September 2020. - The first transaction on Sash’s bank account was on 06 August 2020 when a deposit of £3,000 was made. - Between 06 August 2020 and receipt of the BBL funds on 24 September 2020 the only other credit into the account was £1,295 on 02 September 2020. - No evidence has been provided to show that Sash was carrying on business on or before 01 March 2020. - Sash had generated no turnover prior to making the BBL application on 27 July 2020. - Mr Prodan had provided no explanation regarding how he estimated his turnover. - Mr Prodan applied for the maximum available BBL of £50,000 stating estimated turnover of £300,000, a statement which was not reasonable when Sash had received no turnover in the first 9 months post-incorporation. - Receipt of the BBL took the credit balance on Sash’s bank account to £50,016. - Between receipt of the BBL on 24 September 2020 and 04 March 2021 a total of £31,434 was paid out of Sash’s bank account. Of which £31,418 came from BBL funding. - At least £19,900 was dispersed to or for the benefit of Mr Prodan and not the benefit of Sash. - At liquidation £47,259 remained outstanding in respect of the BBL.
