Conduct: Muhammad Shafqat Islam (“Mr Islam”) caused Foodie N Moodie Ltd (“Foodie”) to apply for a Bounce Back Loan (“BBL”) received on 18 May 2020, contrary to the BBL application criteria, when it was not engaged in trading or commercial activity in the UK at the date of the BBL application and/or was not carrying on business on 01 March 2020. As a result, Foodie was not entitled to obtain a BBL, in that: • The BBL application asked Foodie to declare, amongst other things, that it was carrying on its business on 01 March 2020 and that it was engaged in trading or commercial activity in the UK as at the date of the BBL application, and the business has been adversely impacted COVID-19. • Foodie was incorporated on 4 October 2019. • An application was made by Mr Islam for a Bounce Back Loan of £50,000 on behalf of Foodie. • Foodie’s bank account was opened on 1 November 2019, however the first transaction occurred on 18 May 2020, which was the receipt of the BBL. • Mr Islam has stated that the company was not actively trading between 4 October 2019 and May 2020 and that the company commenced trading from June 2020. Meaning that the company was not eligible to apply for a bounce back loan, as did not meet the criteria. • The BBL funds of £50,000 were paid into the company’s bank account on 18 May 2020. • At liquidation, Foodie had liabilities totalling £87,394 of which at least £45,059 is in respect of the BBL.
