Conduct: Abdus Shahid (“Mr Shahid”) caused Currytwo Ltd (“CT”) to act in contravention of the Bounce Back Loan (“BBL”) scheme by applying for and obtaining a second BBL of £50,000 when prohibited from doing under the terms of the scheme. In that: A Company was entitled to apply for one BBL of up to 25% of its 2019 turnover (or 25% of its projected turnover) up to a maximum of £50,000 under the BBL scheme. CT was incorporated and commenced to trade in October 2019. On 4 May 2020 Mr Shahid applied for a BBL of £50,000 from Bank A. The BBL of £50,000 from Bank A was received by CT on 5 May 2020. On 28 May, CT applied for a second BBL of £50,000 with Bank B. Bank B have confirmed that all BBL applications included the following declaration: “I/We confirm that this is my/our only application for a Bounce Back Loan for this business, and I am/we are not part of a wider group which is in the process of applying or has already received a Bounce Back Loan.” The second BBL of £50,000 from Bank B was received by CT on 28 May 2020. CT was not entitled to the second BBL from Bank B having already applied for and received a BBL of £50,000 from Bank A. The second BBL application was therefore in direct contravention of the BBL scheme terms and conditions. The two banks are creditors in the liquidation and have claimed a total of £100,000 for the outstanding BBLs.
