Conduct: On 11 July 2020, Todd Reiss Tidswell (“Mr Tidswell”) made false declarations in a Bounce Back Loan (‘BBL’) application on behalf of Tidswell Electrical Ltd (“the Company”), by declaring that the Company’s turnover was £250,000, and by declaring that the Company was carrying on its business on 01 March 2020, and was engaged in trading or commercial activity in the United Kingdom as at the date of the BBL application, when in fact the Company was dormant. As a result, the Company has received BBL funds of £50,000 that it was not entitled to, of which £50,000 has been expended for purposes that did not provide economic benefit to the Company, in breach of the BBL terms and conditions.   • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover for the 12 months after the business was started. To be eligible for the scheme, a business had to have been carrying on its business on 01 March 2020, and to have been engaged in trading or commercial activity in the United Kingdom as at the date of the BBL application.     • The Company was incorporated on 03 October 2019.    • On 11 May 2020, Mr Tidswell applied for a BBL of £50,000 on behalf of the Company. The BBL application form asked Mr Tidswell to provide the Company’s annual turnover for the calendar year 2019, or if the business was established after 01 January 2019, to provide the estimated annual turnover from the date the business started. Mr Tidswell stated that the turnover for the Company was £250,000.   • Accounts for the financial years ending 31 October 2020 through to 31 October 2023 were approved by Mr Tidswell, and filed at Companies House. Said These accounts declared that the Company was dormant throughout the period from incorporation on 03 October 2019 until 31 October 2023. As such, the Company was not carrying on business on 01 March 2020, and was not engaged in trading or commercial activity in the United Kingdom as at the date of the BBL application. • The Company operated two bank accounts. Bank statements for the first bank account show that the BBL funds of £50,000 were received on 29 July 2020, with the full amount transferred to Mr Tidswell on 30 July 2020. These were the only transactions on this bank account, with the account subsequently closed on 04 August 2020. The second bank account operated by the Company was opened on 29 October 2020, and there were no transactions on this account until 22 May 2023.    • The sole banking transactions from incorporation until 22 May 2023 were the receipt and subsequent transfer of the BBL funds to Mr Tidswell. As these transactions occurred at a time when accounts declared the Company to be dormant, the transfer of the £50,000 to Mr Tidswell would not appear to have been was not for the economic benefit of the Company.     • Total liabilities at liquidation amount to £55,987 of which £50,627 relates to the amount owed in respect of the BBL.
