Conduct: Khushbinder Abhol (“Mr Abhol”) caused Abacus Management Solutions Limited (“ABACUS”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 on 12 May 2020 to which it was not entitled. Consequently, Abacus received monies it was not entitled to from the BBL scheme and thereafter the BBL monies were not used for the economic benefit of the business, in that: • The Bounce Back Loan (“BBL”) criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover • On 12 May 2020 Abacus applied for and received a BBL of £50,000, which was paid into the company’s bank account on 08 April 2020 • The eligibility criteria included that a business was established and actively trading at 01 March 2020. • Abacus was incorporated on 01 October 2019, but did not start to trade until at least April 2020. • A review of the company bank account following the receipt of the BBL monies shows that between 12 May 2020 and 13 September 2021 payments totalling £40,822 were made which were not for the benefit of the company.
