Conduct: On 8 December 2020 Mr Pape Djibril Diouf (“Mr Diouf”) caused Diouf Door To Door Leafleting Ltd (“DDTDLL”) to apply for a Bounce Back Loan (“BBL”) of £15,000 by providing an overstated turnover figure of £200,000. On 20 December 2020, DDTDLL received a BBL top-up of £30,000. In total DDTDLL received £45,000 that it was not entitled to. Mr Diouf has also failed to provide evidence that £37,100 of the BBL funds were used for the economic benefit of DDTDLL, in breach of the terms of the BBL. In that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from the date the business commenced trading. DDTDLL was incorporated on 27 September 2019. On 8 December 2020 Mr Diouf applied for a BBL of £15,000 on behalf of DDTDLL declaring that turnover was £200,000. Financial accounts for year ending 30 September 2020 show that the actual turnover was £3,210 and Mr Diouf has provided no evidence or explanation supporting the estimated turnover figure he provided in the BBL application. On 14 December 2020 DDTDLL received £15,000 into its bank account. Between 14 December 2020 to 17 December 2020 payments totalling £13,600 were made from DDTDLL’s bank account. Mr Diouf has failed to provide evidence that these payments provided economic benefit to DDTDLL. DDTDLL received a top up BBL payment of £30,000 on 20 December 2020. On 22 December 2020 payments totalling £26,500 were made from DDTDLL’s bank account. Mr Diouf has failed to provide evidence that these payments provided economic benefit to DDTDLL. Total liabilities at liquidation amount to £45,914 of which £45,214 relates to the amount owed in respect of the BBL.
