Conduct: Mr Sami Malaj (‘Mr Malaj’) breached his duties as a director of ABI Valeting Ltd, t/as FS Hand Car Wash (‘ABI’) by failing to ensure that it complied with its legislative duties, in that: • ABI did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (‘the Act’) resulting in the employment of one individual who did not have the right to work in the UK; • Home Office Immigration Enforcement carried out a visit to ABI’s trading premises on 30 April 2024 and identified 1 worker who did not have the right to work. • As a result Home Office issued a Notice of Liability for Civil Penalty on 23 May 2024, amounting to £40,000 in respect of the employment of one worker; • Although an Objection Notice was submitted by Mr Malaj, the penalty was upheld and the Objection Outcome Notice stated that this was due for payment on or before 11 July 2024; • The penalty remains unpaid; • Mr Malaj was the sole director of ABI at the time of the breach of the Act.
