Conduct: On 19 May 2020, Mr Simrandeep Singh Sangha (“Mr Sangha”) caused 1st Step Accommodation Limited (“1SAL”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure, which resulted in 1SAL obtaining a BBL of £50,000 which was more than it was entitled to. Mr Sangha caused 1SAL to expend the £50,000 BBL funds for purposes that did not provide economic benefit to 1SAL, in breach of the BBL terms and conditions. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. Estimations must be provided from the day the company starts actively trading to the day it makes its application for a BBL. • 1SAL was incorporated on 23 September 2019. • On 19 May 2020, Mr Sangha applied for a BBL of £50,000 on behalf of 1SAL declaring that its estimated turnover from the date it began trading was £225,000. • 1SAL submitted accounts for a dormant company to 30 September 2020. Additionally, bank statements confirm that payments into the company bank account prior to the application totalled £8,157.61. • 1SAL received the BBL funds of £50,000 into its bank account on 20 May 2020. • On the 20 May 2020, £50,000 was subsequently withdrawn from the company bank account. Mr Sangha has failed to provide evidence to verify whether this transaction was for the economic benefit of 1SAL. • Total liabilities at liquidation/administration amount to £53,001 of which £50,000 relates to the amount owed in respect of the BBL.
