Conduct: Sylton Hubert Legister (“Mr Legister”) caused I&I Couriers Ltd (“I&ICL”) to obtain a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that it was not entitled, as it was not carrying on its business on 01 March 2020 nor was it engaged in trading or commercial activity at the time of the BBL application on 22 June 2020, contrary to the terms and conditions of the BBL scheme. In that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic; • I&ICL was incorporated on 17 September 2019; • On 22 June 2020, I&ICL obtained a BBL of £50,000. Mr Legister declared on the BBL application that I&ICLs estimated turnover was £200,000. I&ICL received the BBL funds of £50,000 on 22 June 2020; • I&ICL’s accounts for the years ended 31 December 2020 and 31 December 2021 state the company commenced trading on 01 April 2020; • I&ICL’s bank statements show no receipt of trading income prior to the receipt of the BBL funds on 22 June 2020. The first receipt of trading income was received on 16 October 2020; • No evidence has been provided to show that I&ICL was carrying on business on 01 March 2020 nor that it was engaged in business or commercial activity at the date of the BBL application on 22 June 2020. I&ICL therefore obtained a BBL of £50,000 when it was not entitled to a BBL of any amount; • I&ICL ceased trading around July/August 2021; • I&ICL was placed into Creditors Voluntary Liquidation on 12 October 2023; • Total liabilities at liquidation amount to £40,775 of which £35,559 relates to the amount owed in respect of the BBL.
