Conduct: In December 2020 Curtis May (“Mr May”) caused CLM Ventures Ltd (“CLM”) to apply for a £50,000 Bounce Back Loan (BBL) when he knew, or ought to have known, that CLM did not meet the criteria for the BBL. In that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. A company could apply for a loan which was up to 25% of its turnover in the calendar year 2019, from a minimum of £2,000, up to a maximum of £50,000. • The Bounce Back Loan eligibility criteria was that a business had to be engaged in trading or commercial activity in the UK at the date of the application, had to be carrying on business on 1 March 2020 and had to have been adversely affected by coronavirus (COVID-19). • Mr May applied for a £50,000 BBL on 18 December 2020. This was paid into the company bank account on 18 December 2020 • CLM was incorporated on 11 September 2019. • CLM’s accounts made up to 30 September 2020 show a nil turnover. • The company bank statements show that the first transaction was on 18 December 2020 and was the BBL funds being paid into the account • Therefore, the company was not carrying on business at 01 March 2020 or engaged in trading at the date of the BBL application and was not eligible to receive a BBL • Between 18 December 2020 and 18 February 2021, a net amount of £35,989 was paid to Mr May. No records have been produced to show that this was for the economic benefit of CLM. • At liquidation on 01 August 2024 £45,000 of the £50,000 BBL remained outstanding.
