Conduct: Ayesha Siddika Sumaiya (“The director”) caused Carmelhouse17 (“The Company”) to dishonestly obtain a second bounce back loan (“BBL”) of £50,000 on 11 May 2020 when she knew, or ought to have known that the Company was ineligible to receive it in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 1 January 2019 it is their estimated turnover. • One of the conditions of the scheme was that the business could only apply for a single BBL. If the maximum available BBL was not obtained the BBL could be topped up to the maximum determined by the business’ turnover. • One of the conditions of the scheme was that the expenditure of the loan funds was limited solely to business expenditure. Expenditure for personal reasons was specifically prohibited. • The company was incorporated on 01 September 2019 and thus was entitled to estimate its turnover for BBL purposes. • On 08 May 2020, the company successfully applied for a BBL of £37,000 from bank A. The director declared a turnover of £150,000. • On 11 May 2020, the company successfully applied for a BBL of £50,000 from bank B. The director declared a turnover of £220,000 and confirmed, within the application, “that this is my/our only application for a Bounce Back Loan for this business.” • To date, no records supporting the business use of the BBLs have been provided to the liquidator. • As at the date of liquidation, £62,465 of the loans remain outstanding.
