Conduct: Eisa Nawab (“Mr Nawab”) caused Amkah Ltd (“Amkah”) to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures when he knew, or ought to have known, that Amkah was not eligible for any loan under the terms of the BBL Scheme, in that: • under the BBL scheme a business could borrow between £2,000 up to a maximum of £50,000 (25% of its turnover in calendar year 2019). If the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • Amkah was incorporated on 4 September 2019. • on 18 May 2020 Mr Nawab applied for a BBL of £50,000 on behalf of Amkah, stating in the application that Amkah’s relevant turnover was £200,000. • an analysis of the bank statements from October 2019 to 17 May 2020 (the day before the application was made), shows turnover as £760.81. • on 20 May 2020, funds of £50,000 were credited to Amkah’s bank account 1. Between 20 May 2020 and October 2020, the only other payment into the bank account was £363.60. Therefore Amkah’s annual turnover from the date it started did not meet the BBL eligibility criteria. • at the date of the liquidation on 19 October 2023, the Statement of Affairs shows that total liabilities amounted to £50,101, £50,000 of which was in respect of the BBL.
