Conduct: On 26 June 2020 Mr Ryan Siviter (‘Mr Siviter’) caused RAWR Fitness UK Ltd (‘RAWR’) to obtain a Government-backed Bounce Back Loan (‘BBL’) of £50,000 when he knew or ought to have known RAWR was not eligible for. Mr Siviter failed to ensure that the proceeds of the loan were used in their entirety for the economic benefit of the business as required under the terms of the BBL scheme. In that: Obtaining a BBL • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it started if it had been established after 01 January 2019), from £2,000 to a maximum of £50,000; • RAWR was incorporated in September 2019 and was engaged in commercial activity from that time; • As RAWR was established after 01 January 2019 it was permitted to estimate its annual income for the BBL application; • On 26 June 2020 Mr Siviter completed an application form for a BBL from RAWR’s bank, self-certifying that its estimated annual turnover was £252,000 and requesting a loan of £50,000; • Although Mr Siviter has provided details of general market research into an online trading model, he has failed to provide sufficient evidence to support RAWR’s ability to achieve the level of turnover stated in the application. Disbursal of the BBL • The terms of the BBL scheme required the proceeds to be used solely for the economic benefit of the business; • Immediately before the receipt of the BBL the bank account balance was £0; • On 08 July 2020 the BBL was paid into RAWR’s account; • Following this: o On 10 January 2021 £20,000 was paid to Mr Siviter; and o On 14-15 April 2021 £30,000 was paid to a third party; • Although Mr Siviter repaid £20,000 to RAWR in September 2021, a further payment of £20,000 was made to him in October 2021; • Income of £6,219 was received in the period from the receipt of the BBL to 15 April 2021, therefore £43,781 of the £50,000 paid out could not have been funded without the BBL; • Mr Siviter has failed to evidence that these payments were for the economic benefit of RAWR’s business. • At the liquidation date the bank was the only creditor and has claimed £50,492 under the Government guarantee.
