Conduct: Godfrey Dube (“Mr Dube”) breached the terms of the BBL scheme by causing Hewitt Education Limited (“HEL”) to overstate its turnover on its application for a BBL. As a result, HEL received a BBL of £50,000 when Mr Dube knew or ought to have known that HEL was not eligible for a BBL. In that, • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated annual turnover from the date the business started. • HEL was incorporated on 27 August 2019. • On 01 October 2020, Mr Dube applied for a BBL of £42,000 on behalf of HEL declaring that its turnover was £250,000. • 05 October HEL received a BBL of £42,000. • Bank statements show the company received payments of £3,614 between incorporation and 05 October 2020. • On 05 November 2020, Mr Dube obtained a BBL top up loan of £8,000 on behalf of HEL. • Total liabilities at liquidation amount to £61,306, of which £50,806 relates to the amount owed in respect of the BBL.
