Conduct: Cheikhouna Bousso (“Mr Bousso”) caused Darou Khadhim Limited (“Darou”) to apply for and obtain a Bounce Back Loan (“BBL”) of £45,000, when he knew or ought to have known that it was not eligible for the loan under the terms of the BBL scheme. Mr Bousso further failed to ensure that at least £28,219 of the BBL funds were used for the economic benefit of Darou. In that: • Under the terms of the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover and had to be carrying on business on 1 March 2020 and engaged in trading/commercial activity in the UK at the date of the application. The turnover figure was self-certified by the applicant. • Darou was incorporated on 21 August 2019. • On 30 July 2020, Mr Bousso applied for a BBL of £45,000 on behalf of Darou, declaring a turnover of £180,000 and that Darou was carrying on business on 01 March 2020 and that it was engaged in trading or commercial activity at the date of the BBL application. • On 10 August 2020, Darou’s bank account was opened and the BBL funds of £45,000 were paid into the account on the same day. Aside from £200 paid in by Mr Bousso on 10 August 2020, there were no further receipts into the company’s bank account until 12 July 2023. • Darou filed dormant accounts covering the period up to 31 August 2020, indicating that Darou was not trading at the date of the BBL application. • Between 10 August 2020 and 06 September 2021, Mr Bousso made payments to third parties totalling £28,219, which were not for the economic benefit of Darou. • At the date of liquidation, £36,540 remains outstanding in respect of the BBL.
